Terms and Conditions for participants I agree as a participant student to behave in a safe and respectful manor with regard to other participants and the boat and equipment. Safety is the priority despite weather and sea conditions which can change rapidly. Uneven motion may cause nausea or vomiting in some participants and the instructor will return to shore and accomodate the comfort of all participants. Please read carefully: Fresh Air Sailing Academy shall not be liable for any damages howsoever founded, arising out of any cause whatsoever (whether founded in tort or in contract or otherwise) and without limiting the generality of the foregoing claims arising out of any damage abatement or rescue efforts undertaken by the instructor and/or members of rescue services respecting the preservation of person or property, and also including claims for consequential damages arising out of, occasioned by or attributable the nature, construction, design, condition or state of repair of the vessel. The participant agrees to indemnify and save harmless Fresh Air Sailing Academy from and against any and all claims howsoever founded, arising out of any cause whatsoever whether founded in tort or in contract or otherwise and without limiting the generality of the foregoing claims. Liability Waiver As a condition of and in consideration of Fresh Air Sailing Academy accepting me as a participant in the sailing school, the undersigned warrants and covenant as follows: That being fully knowledgeable of the risks of sailing participation by the Student in the sailing program, I do for myself, my executors, administrators to hereby covenant and agree to indemnify each of them against any such claims as may arise.
